The notary María Cristina Clemente has warned of the conditions that must be taken into account by those who want to access the new public loans of up to 50,000 euros to buy a first habitual home. Through a video published on Notaría Buendía’s social networks, the expert recalls that it is not an aid for any buyer, since “it will only be granted to people who buy their house through a mortgage.”
It refers to the TU CASA program, a financing mechanism promoted by the Government that allows up to 20% of the value of a home to be covered, with a maximum of 50,000 euros, through public loans without interest or commissions. The measure is included in article 19 of Royal Decree-Law 29/2026, of October 6, published in the Official State Gazette (BOE) on October 7.
However, Clemente insists that it is important to know the conditions before requesting this financing. “But be very attentive to the fine print of Tu Casa, to its conditions,” he points out, especially because the loan does not replace the bank mortgage and can limit the price at which the home is sold in the future.
The aid of 50,000 euros is only granted if it is purchased through a mortgage
The first condition that the notary highlights is that TU CASA is designed to complement private mortgage financing. Therefore, the public loan cannot be requested independently to cover the missing part in a purchase without a mortgage.
“That is, forget about having received an amount, for example, by inheritance from your parents or by donation and thinking that you can request the 50,000 euros you are missing,” he explains.
Another important point in this sense is that the fact of being able to access this public financing does not necessarily mean that the bank will approve the mortgage.
Regarding amounts, article 19.3 of the Royal Decree-Law establishes that the lesser of two amounts will be financed, that is, 20% of the value of the home or 50,000 euros. For example, for a home worth 200,000 euros, the public loan could reach 40,000 euros, while for one worth 300,000 euros it could not exceed 50,000.
Another important issue is that, even if it has 0% interest and does not charge commissions, the money must be returned. The regulations contemplate a grace period linked to the duration of the mortgage, with a maximum of 30 years, and a subsequent period of up to 10 years to repay the loan.
“Remember, it is a loan, it is not a non-refundable subsidy. You have to return the amount borrowed,” insists Clemente.
Homes purchased with TU CASA will have a maximum sale price forever
The last condition is, for the notary, one of the most important. Those who buy a home using this mechanism should know that they will not be able to sell it later at any price, even after finishing paying both the mortgage and the public loan.
“If you acquire your home through this mechanism, you should know that it will be subject to a permanent maximum transfer price,” he explains.
This is stated in the Royal Decree, which establishes that, in subsequent transmissions, the price may not exceed the acquisition amount updated in accordance with the evolution of the consumer price index (CPI).
The regulations also allow the value of certain rehabilitation or improvement works to be incorporated, under the conditions developed by agreement of the Council of Ministers.
Therefore, even if the owner finishes repaying the two loans, he will continue to be limited in the amount for which he can sell the property.
He paints the roof of his house red and his community of neighbors forces him to change it because it clashes with the rest of the homes.

Furthermore, if the home purchased through TU CASA is rented, the rent must be below the maximum applicable limit according to the reference price index system.
