A city council closes access to the garden of an 81-year-old retiree and the Justice grants her the right of way because she had been using it for 59 years

Living for decades in the same house means getting used to using the same things. accesses and paths to enter and exit the property. Therefore, the last thing owners expect is to find out from one day to the next that one of those steps has been closed and they can no longer use it. Even less is it expected that the City Council itself will block the passage, as happened to this 81-year-old retiree in England, who found that the municipal authority had placed a metal fence in front of the back door of her garden, through which she had been entering and leaving her home for 59 years.

According to information published by Derbyshire Timesthe woman, a retired teacher, had been living in the house since 1967. Since then, she and her family had been using a path that crossed a municipal parking lot next to their property and which allowed them to access the backyard, both on foot and by car.

However, on April 26, 2023, he discovered that the City Council had installed a metal fence in such a way that it blocked the passage just one meter wide that he had on his garden wall, and decided to go to court to regain access, where he was found in favor after almost three years of conflict, granting the right of way.

The City Council blocked the passage that it had been using since 1967

The municipal workers placed a metal panel fixed with cement in front of the door that connected the retiree’s garden with the City Hall parking lot. From what the woman explained, she had been living in the same house for almost six decades and she and her family had used that path for years without anyone objecting.

However, the City Council decided to close the access, preventing him from continuing to enter and exit through the back of his home as he had done until then.

Although the fence was removed approximately a year later, vehicle access remained blocked, so the woman could not use the road to drive her car into the garden.

Justice recognizes your right to use the road and forces the City Council to pay the costs

After considering that the woman had been using that path for more than 40 years continuously and without opposition, the retiree had acquired the right to use the path over time, so the City Council could not prevent her from accessing her home.

The judge criticized the actions of the municipal defense, considering that it had maintained an excessively combative stance despite having little evidence to justify its position.

Finally, the Court ordered that the right of passage be recognized in the property deeds and that the City Council once again guarantee pedestrian and vehicle access to the garden, in addition to taking charge of the retiree’s legal costs.

In fact, municipal workers have already begun to carry out work in the parking lot to enable a path through which the woman can re-enter her car.

One of the retiree’s main complaints is the stress that this entire process has caused her, especially after so many years living in the same house.

“I have taught nine, ten and eleven year olds all my life, but I never expected the City Council to act in such a childish way,” he lamented.

She also assured that she just wanted to be able to live in peace and that the almost three years of conflict had ended up affecting her well-being.

“I just want to live in peace. I am a strong woman and this has brought out my stubborn side,” she explained.
