As collected the medium ‘Confilegal’ In his day, everything happened on June 1, 2019. It was 16:00 in the afternoon when the bride went to the toilet, in a private stay that had been reserved on the farm where the banquet was held, accompanied by their cousins. When leaving, they met the two farm officials in the room, even one of them sitting on the desk “as if they were at home”, with a bottle of water and the computer.

They were informed that “they were from the Treasury” and they came “to seize the wedding” and that, if they did not yield, the wedding “was going to stop if they did not sign some documents”, which never taught them. The boyfriend quickly arrived, together with the catering manager, who offered to solve the problem. However, when everything seemed to be arranged, two civil guard agents arrived around 7:00 p.m.

They did not show any document that endorsed the legality of the requirement

The Treasury officials tried that the Civil Guard passed the data of the bride and groom, that they had refused to facilitate, but the Benemérita replied that, according to the Data Protection Law, they could not provide them without the consent of the interested parties. The National Court condemned the Treasury in 2021

The National Court, in a sentence of 2021, described the performance of the Tax Agency as disproportionate and lacking empathy. “Not even the alleged criminals are treated like this,” the judge said, as explained by lawyer Carlos García.

As this lawyer explains, the National Court failed that the Treasury “had media to notify without ruining an unrepeatable moment.” As confilegal, specifically they stated that “the Almighty Tax Agency has available to media more than enough to achieve the collection of taxes without having to humiliate a debtor before his clients and, incidentally, ruin Marcos and Irene (third parties outside the debt, which were the bride and groom) the celebration of his wedding with about 100 guests.”

“The dehumanization of tax collectors cannot afford until these dimensions. It was only missing that the Tax Agency was dedicated by system to invading the intimacy of citizens in the baptism, communions, weddings and funeral celebrations to retain credits of debtor service companies of the Treasury, whose collection must try to achieve by other less harmful mechanisms for the feelings of the third parties that star in those celebrations. The magistrate said.

For this reason, they condemned the administration to compensate the bride and groom with 6,000 euros. A surrealist case that, as the lawyer Carlos García affirms, left a lesson: “Persecating debts cannot justify everything. Neither the most legitimate power can exert its strength without limits”, adding that it is “a real case that looks like a script of Berlanga … but that portrays something very serious: the collection machinery continues to operate without empathy, and when the disproportion replaces the common sense. victim”.
