Good news for civil servants: they regain the right to partial retirement

An agreement signed between unions (CCOO and UGT) and the Ministry of Digital Transformation and Public Servicerecover the right of officials to partial retirement. With this first step already completed, we will now have to modify the Basic Statute of the Public Employee. And ensuring that civil servants can make employment compatible with collecting part of their pension was one of the objectives to be achieved for a few years.

Already in the month of May, the one who was minister of the branch and now governor of the Bank of Spain, José Luis Escrivá, began to hold meetings with union organizations for the implementation of partial retirement for civil servants and statutory personnel. Partial retirement is a type of retirement from work that makes it possible to make employment compatible with the collection of part of the pension. It may be linked to the relief performed by another worker.

The pact has been signed by both the minister Oscar Lopez as well as by the general secretary of UGT Public Services, Julio Lacuerda and the coordinator of the CCOO Public area, Luciano Palazzo. In this way, periods of intense negotiations have been closed and a request that, from the public administration, had been made on many occasions has been fulfilled.

Now, the next step will be the modification of the Consolidated Text of the Basic Statute of the Public Employee. A measure that has been explained by Minister López who pointed out that “with this agreement we recover a right that had been suppressed with the Government’s adjustment measures in 2012.” At the same time, he points out, an unjustified difference with private company workers is eliminated.

Make employment compatible with collecting a pension

Once the first step has been taken, the arrival of this new figure in the public sector will mean facilitating the transition from active life to retirement. Likewise, it guarantees the knowledge transfer in the civil service between the most veteran workers and those who have just joined.

This agreement will be established according to the rules published by Social Security and for the Passive Classes, with any necessary adaptations. The reference will be the regulatory framework for partial retirement that was agreed upon at the social dialogue table of the Government, the business association CEOE – Cepyme and the unions on July 1, 2024.

The relievers will be career officials

This agreement indicates that in the case of the public sector, the reliever will be regulated as career civil servant personnel. The positions that correspond to public employment or planning positions equivalent to the year in which you are going to retire must be planned.

As these are planned positions, it is guaranteed that the retirement formula does not entail additional budgetary costs.
