In this sense, it must be clear that the Urban Lease Law provides for the form and amount in which the landlord can rise to the tenant in its article 18, in which it indicates that the owner may raise the rent on the date on which each year of the contract is fulfilled.

Now, in this sense it can happen, that despite the fact that homemade and tenant agreed in the rental contract the increases of the income of the same, the owner would not have applied them during the first years of its validity, does this mean that you can no longer apply these increases?

This doubt is clearly resolved by the expert lawyer for rent, Alberto Sánchez, through his social networks, in which he explains, in the doubt of one of the users that “if the owner forgets to update the rent for several years, up to five, can all update you all suddenly.”
This will be so as long as the income increase is provided for in the rental contract, as previously clarified. “If nothing comes, I couldn’t go up,” says Sánchez.
For example, if the annual increase is scheduled and during the first three years it has not been applied, they can rise in the next update, but for this the lawyer explains that it must be done following guidelines.
First, the owner must “notify the tenant in writing to raise the rent for these 3 years.” To do this, it must indicate what the IPC or the IRAV has to be applied, and also “make the mathematical calculation on the income you are paying and would have to pay the updated rent from the following month.”
Now, it is important to note that this does not mean that the ascent has retroactive effect, according to the expert. To see it clearer, if the owner for 3 years has not uploaded the rent, and would have had to charge 10 euros per month, it does not mean that it will charge 360 euros more suddenly for the money stopped charging during those years. If not that from the month following the notification the new income to be paid will be 10 euros.
