The expert lawyer for rent, Alberto Sánchez, explained in a video published on his social networks that the tenant is obliged not only to pay the rent, but to do so within the period set in the contract or a defect in established by law.
This legal period is set by the Urban Lease Law that includes in its article 17.2 that “except for the opposite, the payment of the rent will be monthly and must be made in the first seven days of the month”.
The lessee, therefore, according to the lawyer, cannot pay the income “when you want or when it comes well”, but must adjust to legal or contractual deadlines.
If the tenant is delayed in the payment of the rent, the landlord can request his eviction
Although the tenant pays monthly, “if the tenant is repeatedly delayed in the payment, the owner may terminate the rental contract and throw him out of the house,” explains Sánchez.
The landlord, therefore, will be able to initiate the process of eviction of the tenant due to the breach of his contractual obligations.
From the idealistic real estate portal they also add that one of the improvements ways of preventing delays in the rental contract is to conclude in the lease a clause an anti delinquency. This, according to experts, serves as a warning of tenants, since if they stop paying they can be added to the Morable file.
