When accessing the retirement pension, it must be taken into account that, in addition to complying with the generic lack and specific lack, it is necessary to meet another important requirement, which is the causative fact, especially when accessing the ordinary retirement age. Although this usually coincides with the last day of work, many workers present doubts about what day is that day. In this sense, the Social Security official, Alfonso Muñoz Cuenca, specialized in the pension area, explains easily and easily that the last day of work must be the exact day in which the retirement age is fulfilled, “neither a day earlier nor a day later.”
In a video posted on the YouTube social network, Alfonso explains that “the causative fact to access the retirement pension is labor cessation”, with what it means, that for retirement to be effective, it is necessary, to cease work. That is, to do so, it is necessary that companies go down to the future pensioner in the Social Security system and should do so the same day in which the retirement age is reached. For example, if the worker turns 65, “that is the date on which the decline must be produced, and will be the last day of work.”

This same criteria should be applied for those with the latest retirement ages, since according to Law 27/2011 there are two ages of retirement one set at 65 for those with long contribution races and another progressive that is increasing every year until it reaches 67 years in 2027, so the work leave must occur the same day that that age is reached. “If your retirement age is at 67, that day you must also be quoted and be your last day of work,” Muñoz explains. For this reason, it is not worth advancing the decline or leaving it for the next day, since only ceasing that day, it can be caused by the retirement pension from the next day.
Now, what about self -employed workers? Well, as Alfonso explains, the responsibility falls on the same worker on his own, that is, it is the one that must be processed. Therefore, it must go (in this case yes) a few days before fulfilling the legal age, they approach the Tax Agency and the General Treasury of Social Security to confirm what procedures they must carry out, since for example, to request the pension, it is necessary that they are aware of the payment of the quotas as self -employed (not to be leads to the denial of the pension).
“The cessation must be properly documented and reflected in the system,” says the official. Whether for sale of the business, transfer or simply voluntary, it is essential that on the date of cessation this coincides with the exact day of the birthday that marks the legal retirement age.
What happens if the exact day is not ceased?
In the event that the worker remains high beyond the day the retirement age is fulfilled, Social Security will proceed to reject the application. “The retirement pension will be denied and a new request will have to be submitted with the correct cessation date,” explains Muñoz.
For this reason, the workers who are approaching the retirement age must prepare everything, even more if they are self -employed workers, since as they explain before the end of the video “it is essential to organize it well so that there are no errors that delay or prevent access to the pension”.
