When a house is rented, doubts usually arise from both the landlords and the tenants and among the most common are: How much can the owner raise the rentor even when the rental contract can be extended. Although among people who have pets, one of the most frequent is whether the landlord can prohibit animals in rented housing.

The lawyer Alberto Sánchez, an expert in rental law, explained in a video on social networks that the law allows owners to prohibit the possession of animals in the lease, provided that it is expressly agreed.

Sanchez points out that “it is perfectly legal for the owner to have pets in the rental house.” And he clarifies that the Urban Lease Law does not mention at any time the question of pets, so in these cases the principle of freedom of pact collected in the Civil Code is applied (Article 1.255).

“You can remember what you want as long as it does not go against the law, morality and public order,” says the lawyer. And is that as established by the aforementioned article:

“Contractors can establish the pacts, clauses and conditions that are convenient, provided they are not contrary to laws, morality or public order.”

Therefore, in the case of pets, Sánchez clarifies that it must be something that goes to bed between the parties, but in practice, as the market is located, and it makes it difficult to find a house for rent, “in the end it is the owner who decides.”
