A Dübendorf teacher, a municipality close to Zurich, has charged 39,000 euros corresponding to a salary to which he was no longer entitled. The teacher had resigned from her job, but the City Council, who was the one who paid, continued to enter the payroll of about 1,900 euros for 20 months. When they realized the error, they claimed the money, but she replied that it was impossible to return it, since he had spent it.
Their case, which have published media such as France infoLe Parisien or Zürcher Oberländer, has caused a stir because he is already in the hands of justice. The teacher has also recognized on several occasions that she did not realize that her salary continued to enter her bank account. An affirmation that, at least, makes doubt, since as she recognized and among other things, a car has recently been bought.

It has been the judges who, once analyzed the case, have determined that this money should be returned to the City Council, since it was public funds. In the end, the amount was reduced to just over 32,000 euros, apart from the judicial coasts.
The administration discovered the ruling and notified the teacher
The professor presented her resignation at a school located in Dübendorf, so she should immediately have notified the City Council, so that the payroll entry was stopped. For at least 20 months he was receiving 36,883 Swiss francs (39,000 euros) irregularly.
The error was discovered when the teacher went to the City Council to request a certificate, then the officials realized that money was being paid every month that did not correspond.
Immediately, they asked her to return all the money, but she did not agree, since she assured that she had not spent it.
The teacher pointed out that he had not noticed
The teacher pointed to the Federal Court that she had not acted in bad faith because she had not realized the entry of her salary into the bank account. The City Council, according to her, should have detected the error before, because now I could not reintegrate the money charged more, since it had spent it “in the purchase of a car.”
The judges did not agree that he had declared the amounts he had charged to the Treasury and that he received an email with the payrolls every month. The teacher was convicted to reimburse more than 32,000 euros, plus 2,000 euros on judicial coasts.
