The Government has published this February in the Official State Gazette (BOE) Royal Decree 126/2026, which establishes the interprofessional minimum wage for this year. This regulation means that companies must regularize payrolls for the months that have already passed, paying the minimum wage established with effect from January 1, 2026.
This standard from the Ministry of Labor and Social Economy not only updates the general monthly base, but also places a special focus on temporary workers and short-term workers. Far from being a forecast, the legal text consolidates a general increase of 3.1% that has a direct impact on workers with fixed-term employment contracts whose services to the same company do not exceed one hundred and twenty days.
Increase in the minimum legal working day to 57.82 euros
The measure that temporary workers will notice most is the setting of their new minimum limit per day. The BOE establishes that, for this year 2026, the amount of professional salary for these contracts may not be less than 57.82 euros per legal day in the activity.
To understand it, this means that these workers will receive, together with the general minimum wage, the proportional part of the remuneration on Sundays and holidays. Furthermore, this daily figure already includes the part corresponding to the two extraordinary bonuses to which, at a minimum, every working person is entitled (corresponding to thirty days’ salary in each of them).
Payment for vacations not taken
The Royal Decree also clarifies what happens with the rest period of these short-term contracts. With regard to vacation pay, temporary workers will receive the proportional part of the minimum interprofessional salary corresponding to the minimum legal vacation.
This financial compensation will be specifically applied in cases where there is no coincidence between the period of vacation enjoyment and the duration of the contract. In other cases, if the worker does enjoy his days off during his contract, the remuneration for that period will be made in accordance with article 38 of the Workers’ Statute.
