Maribel Doctor, pensioner with 44 and a half years of contributions: “They unfairly cut my pension every month”

Early retirements give the possibility of collecting the pension before reaching the ordinary retirement age. But there is a trick. And in exchange for advancing retirement, Social Security applies reducing coefficients that reduce the amount that the pensioner will receive and that can be maintained throughout their retirement. That is why there are many retirees who have been demanding an end to these pension penalties for some time now. A request that finally reached the Congress of Deputies this year and that last September took a step forward with the admission for processing by the Government of the Podemos law proposal to eliminate the reducing coefficients in early retirement with 40 or more years of contributions.

These reductions often also affect people who have contributed for more years than necessary to access 100% of their regulatory base. Depending on each modality and how far forward the withdrawal is, the cuts can be significant.

This is the case of Maribel Doctor, a retiree from Seville and member of the Asjubi40 association who has been contributing to Social Security for no more and no less than 44 and a half years and whose pension is penalized for having retired early. According to the information provided by Asjubi40an association that fights to eliminate the reducing coefficients in early retirement, there are hundreds of thousands of retirees with more than 40 years of contributions affected by these reductions.

“I have contributed for 44 and a half years and they cut my pension”

Through a video published on the Asjubi40 YouTube channel, Maribel has once again demanded a solution for those who reached retirement with long careers.

“If there is that fast track for the social, our solution has to be there,” he explains while demanding that action be taken on the reducing coefficients.

Their request is that people who have exceeded 40 years of contributions can access early retirement without suffering a permanent penalty.

“Madam Minister, you say that there are issues that cannot wait for Congress. Justice for those of us who have paid contributions for more than 40 years is precisely one of them,” he states.

In his case, he summarizes the situation with one sentence: “I have contributed for 44 and a half years and they unfairly cut my pension every month.”

They ask to remove the coefficients from 40 years of contributions once and for all

Maribel’s claim is the same one that Asjubi40 has maintained for more than a decade.

The association requests that the reducing coefficients be eliminated in the early retirements of those who have contributed for 40 years or more, regardless of whether the retirement occurred before the ordinary age.

The issue is precisely that having contributed for a longer time does not automatically avoid the penalty. Articles 207 and 208 of the General Law of Social Security They regulate involuntary and voluntary early retirements without establishing a general elimination of these coefficients solely for exceeding a certain contribution period, as explained by the models used in other similar cases.

Maribel believes that after more than four decades contributing to the system, this cut should not continue to be applied.

“If the Government can act ex officio to protect social rights, we demand that it act now with Asjubi40,” he claims.

In this way, his case once again puts on the table the situation of those who began working at a very young age, accumulated especially long careers and ended up accessing their pension early.

Ignacio Solsona, lawyer: “If before the end of the year you can request an early retirement under good conditions, go ahead, but do not make a hasty decision for fear of a future change that we do not even know if it will come”

Alfonso Muñoz, Social Security official: “If you request retirement 2 years before, a 21% penalty may be applied”

In her case there are 44 and a half years of contributions and a reduction that, as she herself denounces, she continues to see reflected every time she collects her pension.
